Terms of Service

These terms govern your use of Vibe Together. They protect creator ownership while giving the Service only the limited permissions needed to work.

1. Agreement and eligibility

These Terms of Service ("Terms") are a binding agreement between you and Future Heritage LLC, a New York limited liability company, governing your access to Vibe Together and related services (the "Service"). By creating an account, starting an authenticated feature, or using the Service after being presented with these Terms, you agree to them and acknowledge our Privacy Policy. Privacy Policy

You must be at least 18 and legally able to enter this agreement. If you use the Service for an organization, you represent that you can bind that organization, and "you" includes it.

2. Accounts and access

  • Provide accurate information and keep your sign-in methods secure.
  • You are responsible for activity performed through your account unless you promptly report unauthorized access.
  • Do not sell, transfer, share, or create accounts through automated or deceptive means.
  • We may set reasonable limits by account or plan and may change those limits as the Service develops.

3. Your music stays yours

You grant Future Heritage a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical formatting, transmit, display, perform, and distribute your content only as reasonably needed to operate, secure, support, and provide the Service according to your settings. This license includes the right to use service providers for those purposes.

The license lasts while your content is hosted or used by the Service and for a reasonable period in backups, security records, transaction records, and legal records. Removing content ends the active service license except where continued retention is technically necessary, legally permitted, or required to protect users and rights.

4. Publishing, visibility, and remixing

Publishing creates an immutable listener snapshot. Public compositions may be discovered throughout the Service. Unlisted compositions are available to anyone with the link. Published compositions are remix-enabled inside Vibe Together by default.

When you publish, you grant other Vibe Together users a non-exclusive, non-transferable, royalty-free license to access and use the published composition only inside Vibe Together to listen, inspect, and create platform remixes. This platform license does not permit them to release, distribute, sell, license, monetize, or commercially exploit your source material outside Vibe Together without your permission.

A remixer owns their original contributions as between that remixer and Future Heritage, but not your underlying work or any third-party material. Remix lineage and attribution do not replace a separate collaboration, split, sample-clearance, or commercial license agreement.

If you deliberately publish a composition as public, you also grant Future Heritage a non-exclusive, royalty-free license to use credited playback, excerpts, visualizations, screenshots, embeds, your public creator handle, and links to that composition to promote Vibe Together on our website, social channels, demos, press materials, presentations, and paid advertising. This promotional license does not apply to drafts or unlisted work. It transfers no master, publishing, royalty, or commercial ownership, and it does not allow us to license or sell your composition as standalone music.

We will credit your public handle and link to the composition where reasonably practical. If you unpublish it, we will create no new promotional uses and will stop active paid placements within 30 days. Existing organic posts, press coverage, recordings, and archives do not need to be recalled.

5. Your rights responsibilities

You may upload, record, generate, collaborate on, publish, or export content only when you have the rights and permissions needed for that use. You represent that your content and use of the Service will not infringe copyright, trademark, privacy, publicity, contract, or other rights.

  • Get permission for third-party samples, stems, recordings, compositions, covers, remixes, voices, names, and likenesses when permission is required.
  • Agree with collaborators about ownership, credits, splits, publishing, masters, and releases. Vibe Together does not determine or administer those arrangements.
  • Vibe Together does not restrict release or monetization of original work that uses only material you created and Vibe Together-provided samples marked as approved for project use. Rights attached to outside material still apply.
  • Respond accurately to ownership disputes and copyright notices.

6. AI features and generated material

Vibe Together uses AI for focused creative tools such as sample generation and musical assistance. It is not a replacement for authorship or a prompt-to-song service. Samples generated through tools we mark as approved for project use may be used in your Vibe Together compositions and exports. Audio, voices, or samples you bring from elsewhere remain subject to the rights and restrictions attached to them.

As between you and Future Heritage, we do not claim ownership of the original prompts or generated material assigned or made available to you, to the extent ownership can exist under applicable law and provider terms. AI assistance does not guarantee that every output is unique, copyrightable, or universally cleared. Future Heritage does not use your creator content to train its own models.

7. Acceptable use

You must follow our Community Guidelines and Copyright Policy. You may not use the Service to infringe rights, harm people, impersonate others, distribute malware, evade limits, scrape or automate access without permission, disrupt security, reverse engineer protected portions except where law allows, or use generated content deceptively or unlawfully. 8. The Service and feedback

Future Heritage and its licensors own the Service, including its software, visual design, branding, documentation, systems, and non-user content. These Terms do not transfer that intellectual property to you. Subject to these Terms, we give you a limited, revocable, non-transferable right to use the Service for its intended purpose.

If you send product feedback, you allow us to use it without restriction or payment. This does not give us ownership of music or other creator content included only to demonstrate the feedback.

9. Paid services

If you buy a paid offering, the price, included features, billing model, and any offer-specific terms shown at checkout are part of your purchase. You authorize Stripe and us to process the transaction and applicable taxes. Refunds, cancellations, and entitlement changes will follow the checkout terms, applicable law, and any policy presented for that offer.

Do not rely on a paid feature or capacity until the checkout page confirms it is included. We may change future pricing and offerings, but we will not retroactively charge you without authorization.

10. Third parties and service changes

The Service depends on third-party platforms and may link to third-party services. Their terms and privacy practices govern their services. We may add, change, suspend, or discontinue features, including beta and AI features. When reasonably possible, we will provide notice of changes that materially affect paid access or stored content.

11. Enforcement and termination

We may remove content, limit features, suspend accounts, preserve evidence, or terminate access when we reasonably believe there is a violation, security risk, legal requirement, nonpayment, or threat to users or the Service. We may act immediately when delay could cause harm. Where appropriate, you may appeal through the contact method in the relevant policy.

You may stop using the Service at any time. Provisions that by their nature should survive, such as ownership, licenses needed for retained records, payment obligations, disclaimers, liability limits, indemnity, and dispute terms, will survive.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." FUTURE HERITAGE DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OPERATION, PERMANENT STORAGE, COMMERCIAL RESULTS, COPYRIGHTABILITY, OR THAT CONTENT OR AI OUTPUTS ARE CLEARED FOR YOUR USE.

Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FUTURE HERITAGE AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FUTURE HERITAGE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where applicable law does not permit them.

14. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Future Heritage and its members, officers, employees, contractors, and providers from third-party claims and related losses arising from your content, your use of the Service, your violation of these Terms, or your violation of another person’s rights. We may control the defense of a covered claim, and you will reasonably cooperate.

15. Governing law and courts

New York law governs these Terms without regard to conflict-of-law rules. Any dispute that cannot be resolved informally must be brought in the state or federal courts located in New York County, New York, and each party consents to those courts. These Terms do not require arbitration or waive a right to a jury trial. Consumer-protection rights that cannot be waived remain in effect.

16. General terms and contact

These Terms and the policies they incorporate are the agreement between you and Future Heritage about the Service. If one provision is unenforceable, the rest remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or asset transfer.

We may update these Terms. We will post the new version and effective date and provide additional notice when legally required. Continuing to use the Service after the effective date means the updated Terms apply.
